Bhojshala Verdict: Constitutional and Historical Perspectives

On May 15, 2026, the Indore Bench of the Madhya Pradesh High Court delivered a historic decision recognizing the Bhojshala complex as the temple of Goddess Vagdevi (Saraswati), overturning 2003 dual-use arrangement barring namaz on Fridays inside the site. Court established an evidence-based system for resolving heritage disputes based on the ASI’s 2024 scientific study, historical evidence connecting the site to Raja Bhoj’s Paramara-era Sanskrit learning center and the persistence of Hindu worship while allowing the Muslim community to seek alternate site for a mosque in the Dhar area.

The decision, which prioritises historical and archeological evidence over administrative compromise, is a significant development in India’s heritage jurisprudence.
